Cariad Canvas Terms and Conditions for Individuals

This Agreement is between the Client and the Cariad Canvas regarding booking and the hire of equipment, it is legally binding.
A Client making a booking, with these Contract Terms and Conditions (communicated in writing, in person or electronically) will constitute the Client’s acceptance of, and agreement to be bound by, their contents. Contract Terms and Conditions (The Agreement) may only be amended to the extent agreed in writing by Cariad Canvas.

In these Contract Terms and Conditions words and expressions shall have their ordinary meaning unless otherwise defined below.
• Agreement (The) means these Contract Terms and Conditions.
• Invoice means the form issued by Cariad Canvas to the Client containing details of the Equipment, Period of Hire and Hire Charge.
• Client (The person entering into a rental agreement) with Cariad Canvas and who is the person responsible to all obligations to this Agreement.
• Equipment is all the physical items included but not limited to: tent(s), carpet, rag rug, painted table, wind up lantern, tea light lantern, bunting, air beds, Futon (special order), decorative throw, scatter cushion and Bedding Pack (optional).
• Hire Charge means the amount payable by the Client to Cariad Canvas as specified in the Invoice. All Hire Charges, including additional Equipment requests must be paid in full at the time of booking and prior to the event.
• Period of Hire means the period of which any equipment is required, as identified when booking and in the Invoice, to be ready and available for use.

2.1 No verbal representations or arrangements are recognized by Cariad Canvas.
2.2 A booking may only be deemed valid once The Client is in receipt of an Invoice and the Agreement from Cariad Canvas. Cariad Canvas will provide an Invoice and Agreement subject to availability and upon full receipt of the Hire Charge.
 2.3 Unless clearly stated on the booking confirmation no tent booking will include entry to any event or include entrance or event tickets.

3.1 When Cariad Canvas Village has been set up the crew chief will do a handover to the allocated village co-ordinator.
3.2 On arrival the Client shall satisfy himself that the equipment as supplied by Cariad Canvas corresponds to the Invoice and Agreement and is in basic working order with fully functional zips having been erected soundly. Any part of the Equipment found to be faulty shall be notified to Cariad Canvas within one day of receiving the equipment. Failure to do so will render The Client responsible for the total payment of the hire.

4.1 Check-in times are as stated on the Booking Invoice unless otherwise informed by email.
4.2 Check-out must be no later than 11am on the departure date or as arranged in advance with Cariad Canvas.
4.3 No refunds will be given for earlier check out.
4.4 Please ensure that you take home all personal belongings but be sure that you leave ALL FURNISHING as you found them. Equipment will be checked for any damaged or missing items. Should there be any damage, or breakage Cariad Canvas will contact The Client who agrees to pay, in full, all replacement or repair costs as set by Cariad Canvas or its representatives.
4.5 The Client accepts full responsibility for all Equipment.

5.1 The Client must accept full responsibility for all equipment and accessories provided.
5.2 The Client shall keep the Equipment in a good condition and not subject it to any misuse or wear and tear over that consistent with normal and reasonable use. Maintaining where applicable the manufacturers’ recommendations.
5.3 The Equipment should not be altered, modified or adjusted without The Cariad Canvas’ prior consent.
5.4 The Client is responsible for reading the guide sheet in their tent and adhering to its guidelines.
5.5 The Client must be aware that any injury or damage caused by disregarding the safety guidelines is entirely the fault of The Client.
5.6 The Client should not use cooking or other gas appliances of any kind inside the tent with the exception of heating appliances supplied and installed by Cariad Canvas.
5.7 The Client should also not use naked flames over and above what is provided by Cariad Canvas. Careful due care and attention must be observed at all times by the Client.
5.8 No smoking allowed in or around Cariad Canvas tents.
5.9 The Client must respect the privacy of other guests at Cariad Canvas Village.
5.10 The Client must be aware that any goods other than Cariad Canvas products will not be accepted as replacement under any circumstances.
5.11 It is the responsibility of The Client to ensure that all possible steps are taken to avoid injury.
5.12 Cariad Canvas does not allow dogs in their tents except by prior arrangement and a charge of £20.
5.13 The Client may bring food and drink for their own consumption only: vending is not allowed.
5.14 The Client should consider other guests regarding noise levels and use of music or sound systems at all times, particularly during evening, night and early morning.

6.1 Payments can be made by bank transfer (bank details are on Invoice), or by cheque, made payable to Cariad Canvas. All payment must be made in full at least 4 weeks prior to the event. Please be sure to quote your Invoice ref number when making payment.
6.2 All payments must be made in accordance with the terms stated on The Owner’s Booking Form or these Contract Terms and Conditions of Stay. The failure to remit payment in advance of the rental term result in the termination of rental Agreement.
6.3 Bookings made in the 4 weeks leading up to the event MUST be paid in full immediately.

7.1 The Client shall during the period of hire be responsible for the maintenance and safe custody of Cariad Canvas equipment. Excluding theft of Cariad Canvas equipment by third parties.
7.2 The Client shall be responsible for any damage and loss caused to Cariad Canvas equipment by his/her acts and omissions regardless of culpability excluding theft of the Cariad Canvas equipment by third parties.
7.3 The Client agrees to pay upon request by Cariad Canvas costs incurred by Cariad Canvas in rectifying the condition of the equipment if it is returned damaged, unclean or incomplete excluding costs arising from theft of Cariad Canvas’ equipment by third parties.

8.1 The Client will indemnify Cariad Canvas against, who will not be responsible for, any and all claims for injury to persons or loss or damage to property.
8.2 The Client expressly acknowledges that Cariad Canvas is not the original manufacturer or supplier of the equipment. Cariad Canvas verifies that equipment is fit for purpose and safe for use by The Client, provided that the Client follows the equipment’s operating instructions, such instructions as per welcome sheet guidelines. Cariad Canvas accepts full liability of any act of negligence by Cariad Canvas and has public liability insurance in place to cover any claims in this respect. No liability for any injury or death from any claim or proceedings directly arising any acts of negligence by the Client is accepted by Cariad Canvas in respect of this contract.

9.1 The Clients data will be held securely by Cariad Canvas, and not passed on to any other third party unless demanded and required to under United Kingdom law.

10.1 The Client must be aware that for cancellation notices received:
• More than 7 days from initial booking date a cancellation admin fee of £25 is applied.
• 14 to 20 days from the agreed period of hire, the payable cancellation 50% of the equipment hire charge.
• 14 days or less from the agreed period of hire, the payable cancellation fee is 100% of the equipment hire charge.

11.1 Cariad Canvas will make every effort to carry out any order accepted, the full performance of it is subject to variation or cancellation by Cariad Canvas in the event of; an Act of God, War, Strikes, Riots, Lockouts or any other disturbances: Fire, Flood, Storm, Gale and Tempest restrictions on the use of Transport, Fuel or Power, Requisitioning Storage of material or transport or any other cause beyond the control of the Cariad Canvas.

12.1 The Agreement shall be construed in accordance with the law of the United Kingdom and any dispute arising hereunder shall be submitted exclusively to the United Kingdom courts’ jurisdiction.
